THE COMMISSIONERS OF BELLEFONTE Delaware

AN ORDINANCE RELATING TO THE ACCUMULATION AND DISPOSAL OP
GARBAGE AND TRASH

It is hereby ordained by the Commissioners of Bellefonte that:

SECTION 1.  Definitions:
(a) "GARBAGE":  When used in this ordinance shall, for the purpose of this ordinance,
have the following meanings: all kitchen and table waste of an animal or vegetable nature;
swill; offal; vegetables; fruits; meats; fish; bones; fats and market refuse.
(b) "TRASH": When used in this ordinance shall for the purposes of this ordinance mean
rubbish, ashes, street cleanings, dead animals, abandoned automobiles, and solid market
and industrial waste, and the term rubbish shall mean paper, cardboard, tin cans, yard
clippings, wood, glass, bedding, crockery and similar materials.
(c) "CONTAINERS":  When used in this ordinance shall, for the purpose of this ordinance
mean receptacles of metal, fiber, or plastic material of substantial construction; shall have
tight-fitting lids or covers which are water tight and shall fit in such a manner as to keep out
water, rats and vermin.

SECTION 2.  Manner of Storage of Garbage Pending Collection.  It shall be unlawful for
any person to keep or cause or suffer to be kept any garbage, either within or without any
house, building or apartment awaiting removal by the garbage collector unless such
garbage is kept in metal or plastic containers and such containers shall be kept covered
with tight-fitting lids except when necessarily removed in the use of said containers.

SECTION 3. Unlawful Accumulation of Garbage or Trash.  It shall be unlawful for any
person to bring garbage or trash into the town for accumulation or collection by the
Town's garbage and trash collector.

SECTION 4.  Placement of Refuse on Streets, Alleys end Public or Private Property
Restricted. No person shall place any garbage or trash in any street, alley or other public
place or upon any private property, whether owned by such person or not, within the
Town except in proper position for collection on the regularly designated trash collection
day or on the day preceding such trash collection day. Garbage and trash may be placed
in the same container. Garbage must be wrapped.

SECTION 5.  Prohibited Manner of Casting, Placing or Deposit of Refuse.  No person
shall cast, place or deposit anywhere within the Town any garbage or trash in such a
manner that it may be carried or deposited by the elements upon the streets, sidewalks,
alleys, sewers, parkways, or other public places or on to any occupied premises within the
Town or throw or deposit same in or upon any vacant lot or backyard.

SECTION 6. Penalty for violation of regulations on garbage and trash disposal.  Any
person, firm, or corporation violating any of the provisions of this ordinance shall be
deemed guilty of a misdemeanor and upon conviction thereof shall be fined in an amount
not exceeding $25.00 and costs of prosecution.  Each day such violation is committed or
permitted to continue shall constitute a separate offense and shall be punishable as such
hereunder.

SECTION 7.  Ordinances or parts of ordinances in conflict herewith are hereby repealed.
